Welcome to OfferPanda ("we," "our," or "us"). We are committed to protecting your personal data and your right to privacy. This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you use the OfferPanda mobile application (the "App").
This policy applies to all users of the App, including everyday consumers ("Users") and registered businesses ("Merchants"). By using the App, you consent to the data practices described in this policy.
1. Information We Collect
We collect information that identifies, relates to, or could reasonably be linked to you. We gather this data in three ways:
A. Information You Provide to Us Directly
- Account Registration Data: When you sign up, we collect your email address, password (stored securely as a cryptographic hash), and a user-generated profile name.
- Merchant Profile Data: If you register as a Store Owner, we collect your business name, physical address, contact numbers, and any images/logos you upload. Note: Merchant profile data is intended to be publicly visible on the App.
- Communication Data: If you contact our support team, we collect your email address and the contents of your message.
B. Information We Collect Automatically
- Location Information: With your explicit permission, we collect your device’s precise geolocation data (GPS) to show you relevant, nearby deals and calculate distances to stores. This includes background location data to alert you of relevant offers when you are near participating stores, even if the app is not actively open on your screen. If you deny this permission, we may use your IP address to determine your general location (e.g., city-level) to provide basic functionality.
- Device Information: We collect hardware model, operating system version, unique device identifiers (e.g., Android Advertising ID or Apple IDFA), and mobile network information.
- Usage Data: We track how you interact with the App. This includes the time you log in, the offers you view, the deals you save to your wallet, and the stores you follow.
- Push Notification Tokens: We generate a unique device token to send you real-time alerts regarding expiring deals or stores you follow.
C. Information from Third Parties
- Payment & Subscription Data: If you purchase a Premium Subscription, your payment is processed directly by Google Play Billing or Apple In-App Purchases. OfferPanda does not collect or store your credit card numbers. We only receive a secure digital receipt (a purchase token) via RevenueCat to verify your active subscription status.
2. How We Use Your Information
We strictly use your data to operate, improve, and secure the OfferPanda platform. Your information is used to:
- Provide Core Services: To create your account, display local deals, and facilitate the saving/claiming of offers.
- Personalize the Experience: To rank and recommend deals based on your location and past engagement (e.g., our Bayesian Rating system and distance algorithms).
- Process Subscriptions: To unlock Premium features for Users and Merchants upon successful payment verification.
- Provide Analytics to Merchants: We provide Store Owners with aggregated, anonymized data (e.g., "150 people viewed this offer, and 20 saved it"). We absolutely never share a User's personal email address or exact identity with Store Owners.
- Communicate with You: To send administrative emails, policy updates, and push notifications (which you can opt out of at any time).
3. How We Share Your Information
We do not sell, rent, or trade your personal data to third-party data brokers or advertising networks.
We only share your information in the following limited circumstances:
- Service Providers (Our Infrastructure): We share data with trusted third-party companies that host our database, process our notifications, and manage our subscriptions. These providers are bound by strict confidentiality agreements.
- Supabase: For secure cloud database hosting and user authentication.
- Cloudinary: For cloud-based image storage and delivery. Offer images, store logos, cover photos, and review images uploaded by Merchants and Users are transmitted to and stored on Cloudinary's servers. Cloudinary is used solely for media hosting and does not use this data for advertising or independent profiling.
- RevenueCat: For verifying App Store/Play Store subscriptions.
- Google Firebase/GCP: For crash reporting, analytics, and delivering push notifications.
- Legal Obligations: We may disclose your data if required by law, subpoena, or other legal processes, or to protect the rights, property, and safety of OfferPanda, our users, or the public.
- Business Transfers: If OfferPanda is involved in a merger, acquisition, or sale of assets, your data may be transferred as part of that business transaction.
4. Data Security and Retention
Security Measures: We implement robust, industry-standard security protocols. Our backend database utilizes Row Level Security (RLS) to ensure that Users and Merchants can only access data they are authorized to view. All data transmitted between your app and our servers is encrypted using SSL/TLS.
Data Retention: We retain your personal data only for as long as your account is active or as needed to provide you with the App's services. If you delete your account, your personal data will be permanently erased from our active databases within 30 days, except for anonymized telemetry data or information we are legally required to keep for tax/accounting purposes.
5. International Data Transfers
OfferPanda is operated in Sri Lanka; however, the third-party cloud infrastructure we use (such as Supabase and Google) operates on global servers. By using the App, you acknowledge that your data may be transferred to, stored, and processed in facilities located outside of Sri Lanka. We ensure our service providers adhere to internationally recognized data protection standards.
6. Your Rights (PDPA Compliance)
Under the Personal Data Protection Act No. 9 of 2022 of Sri Lanka, and in compliance with global App Store guidelines, you retain full control over your data:
- The Right to Access & Rectification: You can view and update your profile information directly within the App's settings.
- The Right to Erasure (Account Deletion): You have the right to be forgotten. You can instantly delete your account and all associated personal data by navigating to Settings > Account > Delete Account inside the App.
- The Right to Withdraw Consent: You can revoke our access to your device's location or push notification permissions at any time through your mobile device's native OS settings.
7. Children's Privacy
OfferPanda is not intended for children under the age of 18. We do not knowingly collect personal data from anyone under 18. If we become aware that we have collected data from a minor without parental consent, we will take immediate steps to delete that information.
8. Changes to This Privacy Policy
We may update this Privacy Policy from time to time to reflect changes in our practices or legal requirements. We will notify you of any material changes by updating the "Last Updated" date at the top of this policy and, if the changes are significant, by sending an in-app notification.

10. Request Account and Data Deletion
In compliance with Google Play’s User Data policy, you may request the complete deletion of your account and associated personal data at any time, even if you have already uninstalled the app. To request account and data deletion via the web, please email us at offerpandaapp@gmail.com with the subject "Account Deletion Request". We will process your request within 7 business days.

These Terms & Conditions govern your use of the OfferPanda mobile application and services.
1. Acceptance of Terms
By downloading, accessing, or using the OfferPanda mobile application ("the App"), you agree to be bound by these Terms and Conditions. This agreement is legally recognized under the Electronic Transactions Act No. 19 of 2006 of Sri Lanka. If you do not agree to these terms, you must immediately uninstall and cease using the App.
2. Definitions
- "OfferPanda", "We", "Us": Refers to the owners and operators of the OfferPanda application.
- "User": Any individual who downloads the App to view, save, or claim deals.
- "Merchant" / "Store Owner": Any business entity that registers on the App to post offers, deals, or advertisements.
3. The Role of OfferPanda (Platform Disclaimer)
OfferPanda operates strictly as a digital aggregator and marketing platform. We are not a vendor, retailer, or manufacturer.
We do not sell, supply, or guarantee the quality, safety, or legality of any goods or services advertised by Merchants.
Any transaction, dispute, or claim regarding a product or a refused discount is strictly between the User and the Merchant.
Merchants are solely responsible for ensuring their offers comply with the Consumer Affairs Authority Act No. 09 of 2003. OfferPanda accepts no liability for unhonored deals, inaccurate pricing, or business closures.
4. Merchant Obligations
By upgrading to a Premium Store Account or posting offers, Merchants agree to:
- Honor all deals and discounts exactly as they are published on the App for the stated duration.
- Ensure they hold the legal rights to all logos, trademarks, and images uploaded to the platform.
- Not post false, misleading, or deceptive pricing.
OfferPanda reserves the right to suspend or terminate any Merchant account without a refund if they repeatedly fail to honor deals or receive excessive User complaints.
5. Subscriptions and In-App Purchases
OfferPanda offers Premium Subscription tiers for both Users and Merchants.
- Billing: All subscriptions are processed securely through Google Play Billing (and Apple In-App Purchases). OfferPanda does not process or store your credit card information.
- Auto-Renewal: Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period.
- Cancellations & Refunds: Users and Merchants must manage their subscriptions and cancellations directly through their Google Play or Apple ID account settings. OfferPanda does not issue direct refunds for digital subscriptions.
- Instalment Split Payments & Partner Bank Cards: We may feature offers that allow you to pay in instalments via supported external providers, or special deals applicable exclusively when using eligible Partner Bank Cards.
6. Limitation of Liability
To the maximum extent permitted by Sri Lankan law, OfferPanda shall not be liable for any indirect, incidental, special, or consequential damages, including lost profits, lost data, or business interruption, arising out of your use or inability to use the App.
7. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the Democratic Socialist Republic of Sri Lanka. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts of Colombo, Sri Lanka.
Merchant Terms of Service (Addendum)
Empowering your business is our priority. These additional terms apply when you register as an OfferPanda Merchant, designed to foster a trusted, high-quality ecosystem for both you and your customers.
1. Business Representation & Verification
By partnering with us as a Merchant, you confirm that you are a legally registered business entity in Sri Lanka, possess the authority to bind your business to these terms, and ensure all provided details—such as your business name, address, and contact information—are accurate and current.
2. Offer Integrity & Seamless Fulfillment
Trust is the foundation of the OfferPanda community. To ensure a delightful experience for your customers, you agree to:
- Honor Published Deals: Seamlessly honor all active, unexpired offers displayed on the App at your physical storefront. Refusal to honor a valid, unexpired deal may result in immediate account suspension.
- Manage Stock Availability: Take ownership of your offer durations. If a promotional item runs out of stock, simply hide or expire the offer instantly via your Merchant Dashboard.
- Stay Compliant: Ensure all promotions adhere to the Consumer Affairs Authority Act No. 09 of 2003, avoiding any misleading pricing or "bait-and-switch" tactics.
3. Promoting Your Brand (Intellectual Property)
To help us maximize your visibility, you grant OfferPanda a non-exclusive, worldwide, royalty-free license to use and beautifully display your business name, logos, and uploaded product images. This enables us to showcase your brand within the App and across our broader social media marketing channels.
4. Premium Subscriptions & Billing
Unlock enhanced visibility, deep analytics, and advanced deal structures (like Partner Bank Card offers) by subscribing to our Premium tiers.
- Secure Processing: All billing is safely managed through the Google Play Billing system. We never store or directly process your financial credentials.
- Subscription Management: All digital subscription sales are final. You maintain full control over your subscription and can manage cancellations directly through your Google Play account settings.
5. Liability & Indemnification
OfferPanda proudly serves as a digital aggregator connecting you to eager customers, but we are not responsible for the quality, safety, or delivery of the goods and services you sell.
Indemnity: As a Merchant, you agree to indemnify and hold OfferPanda harmless from any claims, damages, or legal fees arising from your products, services, or instances where a published deal could not be honored.
6. Maintaining Platform Excellence (Termination)
To protect our user community, OfferPanda reserves the right to suspend or terminate Merchant access without notice if:
- An account receives repeated, verified complaints from Users regarding unhonored deals.
- The Merchant posts content that is illegal, offensive, or infringes on third-party intellectual property rights.
